Samsung Electronics was sued by a Florida man on Friday who claimed severe injuries after this Galaxy Note 7 smartphone exploded in front pants pocket.

This is the first lawsuit – filed by Jonathan Strobel – in the United States by a Note 7 user against the Korean company due to faulty battery explosion. There are multiple fire and burn issues of Galaxy Note 7 reported in United States in past several weeks.

Last week, US Consumer Product Safety Commission (CPSC) warned US citizens to immediately stop using and power off all Galaxy Note 7 due to safety concerns.

The news came after one day when Samsung has formally recalled about 1 million faulty Galaxy Note 7 units sold in the United States.

The US safety regulators had also released the US incident counts for Galaxy Note 7 which has reached to 92 units due to faulty batteries, including 26 incidents of burns and 55 incidents of property damage.

“We don’t comment on pending litigation”, Samsung spokeswoman Danielle Meister Cohen said in an email. “We are urging all Note 7 owners to power their device down and exchange it immediately.”

Strobel, 28 of Boca Raton, said he was in a Costco in Palm Beach Gardens on September 9th when his Galaxy Note 7 exploded. He told the phone burnt when it was in his pants’ right front pocket, causing severe burns on his right leg.

Strobel further added that his left thumb was also severely burned when he tried to remove the burning phone from his pants.

“He has a deep second-degree burn, roughly the size of the phone, on his right thigh”, Strobel’s lawyer Keith Pierro said. “Unfortunately for my client the recall came too late”.

The lawsuit was filed in a Florida state court in Palm Beach County. The victim seeks unknown damage amount for medical bills, lost wages, pain & suffering and other alleged injuries.
